Joint Press Release: HSF and FUL on Lt-General Berning Ntlemeza

The North Gauteng High Court today dismissed the application for leave to appeal brought by Lt-Gen Berning Ntlemeza and upheld the application made by the Helen Suzman Foundation (‘HSF’) and Freedom Under Law (‘FUL’) seeking enforcement of the order of 17 March 2017 notwithstanding any appeals which may be initiated in the future. Effectively, that order found that his appointment as head of the DPCI is unlawful and was set aside. In this exceptional case the Court found that the applicant had shown that were Lt-Gen Ntlemeza to remain in office the public would suffer irreparable harm. This judgment supports the principle that state administration should be rational and within the confines of the law.
